Evropské úřady mají mít právo identitfikovat uživatele, který je podezřelý z neoprávněného šíření autorsky chráněného obsahu, podle jeho IP adresy a tyto údaje po nezbytnou dobu uchovávat. Ve svém stanovisku ke sporu franouzských spolků na ochranu internetových svobod s tamní vládou (PDF) to napsal generální advokát Soudního dvora Evropské unie (SDEU). Jeho názor není pro soud závazný, může ale sloužit jako vodítko pro konečné rozhodnutí.

Případ se týká specifických francouzských opatření proti šíření pirátského obsahu. Podle tamních zákonů Vysoký úřad pro šíření děl a ochranu práv na internetu, známý pod zkratkou HADOPI, může na žádost držitelů autorských práv přijímat určitá opatření proti jejich porušování.

Má právo si od poskytovatele připojení zjistit kontaktní údaje o uživateli, který se připojuje z určité IP adresy, a poslat mu upozornění, že na jeho připojení bylo pozorováno porušení copyrightu. Poskytovatel pak musí půl roku monitorovat, jestli se přečin nezopakuje. V případě opakovaného prohřešku může případ skončit u soudu, kde uživateli hrozí pokuta.

Čtyři organizace na ochranu internetových svobod ale tuto praxi napadly u francouzského soudu. Namítají, že sběr osobních údajů o uživatelích IP adres je nepřiměřený. Porušení autorských práv totiž podle nich není natolik závažným prohřeškem, aby takový zásah do soukromí ospravedlňoval. Požadují proto, aby sběr dat musel být vždy předem přezkoumán a povolen soudem.

Spor v roce 2021 doputoval k Soudnímu dvoru EU (případ C-470/21) s žádostí o odpověď na otázku, zda je soudní přezkum v tomto případě nutný a v jakém rozsahu by měl případně probíhat.

První generální advokát Maciej Szpunar teď k případu vydal své stanovisko. Praxe HADOPI podle něj neporušuje evropská pravidla:

… unijní právo [by] mělo být vykládáno v tom smyslu, že nebrání opatřením, která stanoví plošné a nerozlišující uchovávání IP adres přidělených zdroji připojení, po nezbytně nutnou dobu za účelem prevence, vyšetřování, odhalování a stíhání trestných činů spáchaných na internetu, u kterých je IP adresa jediným prostředkem vyšetřování umožňujícím identifikovat osobu, které byla tato adresa přidělena v okamžiku spáchání trestného činu.

Přístup HADOPI k osobním údajům o uživatelích IP adres je podle něj odůvodněný. 

… přístup úřadu Hadopi k údajům o totožnosti spojeným s IP adresou se jeví být rovněž odůvodněný cílem obecného zájmu, pro který bylo toto uchovávání poskytovatelům služeb elektronických komunikací uloženo, takže by přístup k těmto údajům měl být umožněn ke sledování téhož cíle, protože jinak by byla připuštěna obecná beztrestnost trestných činů spáchaných výhradně na internetu.

Soudní přezkum sběru dat není podle něj potřeba, protože úřad data používá výhradně k dosažení sledovaného cíle a kromě kontaktu nezískávážádné další informace o uživatelově chování na internetu. Uživatelé se podle něj navíc mohou proti postupu HADOPI odvolávat k vyšší instanci.
